Victims were subjected to psychological torture and maybe physical when the burglary took place and, hence, deserve justice to be accorded to them, as this is their constitutional right.
Convicting the burglar with no clear and conclusive evidence that the individual committed the act is not only unfair but also an abuse of the freedom of movement of that individual because the person may not have committed the burglary. If the person is wrongfully convicted, he can sue the D.A (Pollock2011).
The most ethical decision for the D.A. to make in this case is to let the said burglar serve probation in the community. This is not only moral and ethically justified but it will be a win-win situation for both parties and especially if they are told of the repercussions of taking the case to trial (the victims may lose the case due to lack of conclusive evidence or the burglar may be convicted of a crime he did not perform).
